A Jackson County Circuit Court judge has upheld an arbitration award for the firefighter behind a deadly 2021 Westport crash — the second time the City of Kansas City has failed in court to overturn the award.

Raymond Salva, Jr., the attorney for IAFF Local 42, said the case was never about whether Biscari’s actions were tragic — it was about whether the city followed its own rules.

“The city can hold employees accountable for the discipline that they have coming arising from the employment relationship and at the same time provide due process, just cause and grievance rights, because those two things are not mutually exclusive,” Salva said.
